The FTC is cracking down.

The FTC recently posted a ruling on the use of testimonials and endorsements in advertising and on blogs. The ruling will probably result in a dramatic reduction in the amount of hype found in ads. You can read the complete ruling at http://ftc.gov/opa/2009/10/endortest.shtm . You can also read FrankĀ  Kern’s take on the ruling at http://masscontrolsite.com/blog/?p=59 .

My opinion is to comply with the ruling and for etical marketers the fallout will be nil. In saying that realize I am not an attorney and I am not giving legal advice.. If you need legal advice consult an attorney.

I am sure there will be some who will try to find a way around the ruling and will keep on bending the rules until they get caught and fined. If you read the ruling notice and want the complete guide to the information there is a link to a pdf on the right side of the page.

So in your marketing and copy pay attention to waht you are saying as the safe harbour of “results not typical” no longer is valid.
